The City Council requests that you limit your presentation to three (3) minutes per person, per item, so that all present will have time to participate. The City Council reserves the right to reasonably limit the total time for public comment on any particular noticed agenda item as it may deem necessary.

Members of the audience may comment on any item not on the agenda that is of interest to the public and within the subject matter jurisdiction of the City Council. Each person will be allowed three minutes, or less if a large number of requests are received on a particular subject. The City Council cannot take action on non-agendized items raised under “Public Comment” until the matter has been specifically included on an agenda as an action item. Members of the public desiring a response to a specific question are encouraged to contact any member of the Council or the City Manager at any time. Those audience members who wish to address a specific agendized item are encouraged to offer their public comments during consideration of that item.

7.5 Adopt resolution approving the reallocation of unspent American Rescue Plan Act State and Local Fiscal Recovery Funds to the Homeless Shelter Project and authorizing the necessary budget adjustments [p. 1-5] (FINANCE)

7.6 Adopt resolutions declaring intention to 1) annex territory to Street Maintenance District No. 1, Zone 2-K (Annexation No. 11) and to levy a special tax to pay for street maintenance for the Dunisch Project; and 2) annex territory to Storm Water Drainage Fee Zone 2 (Annexation No. 79) for the Dunisch Project pursuant to the Benefit Assessment Act of 1982 [p. 1-23] (FINANCE)

7.7 Adopt resolution authorizing the City Manager to execute a Credit Reimbursement Agreement with 60 Acre Construction, LLC, for privately constructed public facilities included in the Elk Grove Southeast Policy Area (SEPA) Park and Trail Impact Fee Program for the benefit of the Telos Greens Project [p. 1-21] (FINANCE)

7.8 Adopt resolution 1) authorizing the City Manager to issue refunds related to City development impact fees paid on building permits issued for certain accessory dwelling units and office buildings and amending the Fiscal Year 2026-27 budget to reflect these expenditures; and 2) authorizing the Finance Director to issue any future refunds for overpayment of City development impact fees and to make the necessary budget adjustments to account for the expenditures [p. 1-5] (FINANCE)

7.9 Adopt resolution authorizing the City Engineer to execute the Subdivision Improvement Agreement and approving the Final Map for the Dunisch Subdivision Project (Subdivision No. 22-047) (CEQA Exempt) [p. 1-29] (DEVELOPMENT ENGINEERING)

7.10 Adopt resolution authorizing the City Manager to execute an Economic Development Agreement between the Greater Sacramento Economic Council and the City of Elk Grove for a term of one year in the amount of $73,137, or other such amount as may be directed by the City Council, and authorizing the City Manager to execute up to two one-year extensions in amounts calculated at the time of extension as stipulated in the Agreement, but in no event greater than the amount budgeted for such purposes in the annual budget for each year, subject to City Council approval [p. 1-14] (ECONOMIC DEVELOPMENT)

7.11 Adopt resolution approving the Elk Grove Florin Road Complete Street & Resurfacing Project (WTR078) (Federal Project: STPL-5479(077)); authorizing the City Manager to execute a construction contract with Radius Earthwork, Inc. for the Project in the amount of $1,866,115.06; authorizing the Public Works Director to approve change orders not to exceed $373,223; and authorizing the City Manager to execute a construction contract with the second lowest bidder if the first lowest bidder does not meet filing obligations, or take alternative action as deemed appropriate (CEQA Exempt) [p. 1-8] (PUBLIC WORKS)

7.12 Adopt resolution dispensing with the formal request for proposal procedure pursuant to Elk Grove Municipal Code Section 3.42.140(B)(3) and authorizing the City Manager to execute the Second Amendment to the contract with Sloan, Sakai, Yeung & Wong, LLP for legal services, revising the hourly billing rates and increasing the total compensation amount by $70,000, or other such amount as may be directed by the City Council (for a total contract amount not to exceed $140,000) [p. 1-8] (HUMAN RESOURCES)

7.13 Adopt resolution dispensing with the formal request for proposal procedure pursuant to Elk Grove Municipal Code Section 3.42.188(B)(3), and authorizing the City Manager to execute the second amendment to the contract with JustFOIA, Inc. (Contract No. C-24-686), for records request management software, extending the term through October 31, 2027, and adding $23,000, or other such amount as may be directed by the City Council (for a combined total contracted amount not to exceed $120,000 over a period of six years) [p. 1-7] (CITY CLERK)

7.14 Receive Biennial Notice of Intention to Amend the Elk Grove Conflict of Interest Code [p. 1-8] (CITY CLERK)

8. PUBLIC HEARINGS

8.1 SUBJECT: A public hearing to consider a resolution approving the Fiscal Year 2025-2026 Community Development Block Grant (CDBG) and HOME Investment Partnerships Program (HOME) Consolidated Annual Performance and Evaluation Report (CAPER) (CEQA Exempt) [p. 1-80]

RECOMMENDATION:
Adopt resolution approving the CAPER; authorizing the City Manager to submit the CAPER to the U.S. Department of Housing and Urban Development (HUD); and authorizing staff to make minor technical modifications and/or necessary corrections to the CAPER as may be required by HUD.

8.2 SUBJECT: A Public Hearing to consider 1) an ordinance amending Elk Grove Municipal Code Chapter 16.88 (Affordable Housing Fee for Residential Development) and Chapter 16.89 (Affordable Housing Fee for Nonresidential Development); and 2) a resolution adopting the Elk Grove Affordable Housing Impact Fee Update Nexus Study and setting fees for the Affordable Housing Fee Program (CEQA Exempt) [p. 1-256]

RECOMMENDATION:
1) Introduce an ordinance amending Elk Grove Municipal Code Chapter 16.88 (Affordable Housing Fee for new Residential Development) and Chapter 16.89 (Affordable Housing Fee for new Nonresidential Development); and

2) Adopt resolution adopting the Affordable Housing Development Impact Fee Update Nexus Study dated June 30, 2026, and adopting, levying, and establishing the fees for the Affordable Housing Fee Program as set forth in Chapter 16.88 (Affordable Housing Residential Development Fee) and Chapter 16.89 (Affordable Housing Nonresidential Development Fee) of the Elk Grove Municipal Code.

9. REGULAR AGENDA ACTION ITEMS / RECOMMENDATIONS
