'Protect Elk Grove' Seeks to Have Elk Grove Mayor Singh-Allen Recused From Maverik Appeal

In a letter dated November 10, Protect Elk Grove (PEG) is seeking to have Elk Grove Mayor Bobbie Singh-Allen removed from the appeal hearing over the proposed Maverik fueling station. PEG has appealed the September 18 decision by the Elk Grove Planning Commission to develop a fuel station, which some are referring to as a truck stop, on Highway 99 and Grant Line Road.

The letter from San Francisco-based attorney Edward Yates asserts that Ms. Singh-Allen, who is employed as President of the American Petroleum and Convenience Store, and her participation in the appeal constitute a conflict of interest. The appeal will be heard during the Wednesday, November 12, Elk Grove City Council meeting.

Yates argues, "If Mayor Singh Allen involves herself in any way regarding Elk Grove's consideration of the Maverik permits, she will be violating the Political Reform Act and Fair Political Practice Regulations by acting as a lobbyist and not disclosing that role where she indirectly benefits, and for not or recusing herself from said permitting decisions."

The letter (see below) cites government code and case law, arguing the Mayor should not be allowed to participate in the hearing. Near the end of the letter, Mr. Yates asserts, "Mayor Singh Allen is essentially a lobbyist and, therefore, the very nature of her businesses and her intertwined relationship with the industry demonstrates unacceptable bias over any decision where she is representing the voters and taxpayers of Elk Grove."
