Elk Grove Police sued over forceful arrest; victim’s wife alleges officer tried intimidating her

A local man has filed a lawsuit against the City of Elk Grove, its police department, and an officer, alleging he was violently taken down by police without cause in front of his home and left unconscious with head injuries. 

The complaint, filed by Gian Hansra and his attorney Alaina N. Ybarra, stems from a February 28, 2024, incident in which Elk Grove Police officers responded to a reported disturbance at Hansra’s home. According to court filings, Hansra and his wife, Ramandeep Kaur, had a non-physical argument when officers arrived. 

Ms. Kaur's declaration says that officers entered their home and repeatedly questioned her, trying to get her to say her husband assaulted her—even after she assured them nothing had occurred.

“I felt that his conduct was unprofessional,” Kaur said of Officer Gustavo Aguilar. “He was trying to scare me and get me to say something against my husband… He treated me like I was a criminal.”

After the officers left the house, Aguilar confronted Hansra outside. Though Hansra claims not be be physically aggressive, the complaint states that Aguilar performed a “dangerous leg sweep” maneuver, causing Hansra to fall backward and strike his head on the concrete driveway. Mr. Hansra was rendered unconscious and later taken to an area hospital after initially being placed in a patrol car.

Hansra sustained a head injury and claims lingering symptoms, including memory issues, numbness, and back pain. He was never arrested or charged following the incident, yet faced nearly $22,000 in medical bills.

According to filings, Hansra attempted multiple times to retrieve a police report and file a claim but encountered barriers. Police staff allegedly failed to inform him of the formal process or provide the correct claim form. 

By the time his attorney submitted a formal request to file a late claim on January 6, 2025, beyond the six-month deadline, it was denied by the city on January 22, 2025.

Attorney Alaina Ybarra cited both the Elk Grove Police Department’s refusal to provide essential records and Hansra’s language barriers as reasons for the late filing. “The Elk Grove Police Department does not make it convenient to file claims for police brutality to the public,” Ybarra stated in the petition.

Hansra is now seeking relief from California Government Code §945.4, which restricts legal claims against public entities if not filed within six months of the incident. His request includes permission to pursue a lawsuit for personal injury, assault, and false imprisonment.

The complaint was filed in Sacramento County Superior Court on July 14, 2025. Gian Hansra is represented by attorney Alaina N. Ybarra of Fresno. As a matter of policy, the City of Elk Grove does not comment on pending litigation.
